Terms of Use for Background Changer

1. Acceptance of Terms

"Background Changer" ("Service", "Widget", "Product") is a website background personalization widget developed and owned by Krzysztof Jaroszuk ("Developer", "We", "Us"). By accessing, purchasing, downloading, or using the "Background Changer" widget, you ("Customer", "User", "You") agree to comply with and be bound by these Terms of Use.

These Terms constitute a legally binding agreement between you and the Developer. If you are purchasing on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

"Background Changer" is a client-side JavaScript widget that allows website visitors to personalize website backgrounds. The widget includes:

• 124 Background Options: 20 themes (gradients and animated gradients) and 104 SVG graphics
• Customization Features: 5 adjustable settings (overlay mode, transparency, contrast, saturation, animation speed)
• 22 Visual Styles: 11 styles without rounded corners and 11 styles with rounded corners for the opening button and widget window
• 10 Positioning Options: Flexible placement of the opening button on the left or right side of the browser window
• Marketing Function: Social media sharing capabilities (Facebook, YouTube, Instagram, TikTok, Twitter, Pinterest)
• Easy Implementation: One line of code implementation with 3 files and 1 folder

3. License Grant

3.1. Single Website License

Upon purchase, you receive a single, non-exclusive, non-transferable license to install and use the "Background Changer" widget on one (1) website domain.

The license permits you to:

• Install the widget on one production website
• Use the widget on unlimited subdomains of the licensed domain
• Use the widget during development and testing phases
• Customize the widget's appearance using the provided 22 styles and 10 positioning options
• Update the widget with future graphic packs (available for separate purchase)

3.2. License Restrictions

You may NOT:

• Install the widget on multiple unrelated websites (additional licenses required)
• Resell, redistribute, sublicense, or transfer the widget to any third party
• Modify, decompile, reverse engineer, or attempt to extract the source code
• Use the widget in any product or service that competes with "Background Changer"
• To use or distribute SVG graphics from the “background_changer” folder in a manner inconsistent with their intended purpose (e.g. stock platforms, etc.). The SVG graphics must be strictly associated with the “background_changer” folder and used together with the three files (loader.js, widget.js, widget.css), and the entire package may be placed only on your own website (main domain and subdomains).
• Remove or alter any copyright notices, trademarks, or proprietary markings
• Use the widget for any illegal, obscene, or offensive purposes

This license is granted per purchase. Each purchase entitles you to install the widget on one website domain. Sharing files with third parties constitutes copyright infringement and may result in legal action.

3.3. Multi-Site Licenses

For use on multiple websites, you must purchase a separate license for each website.

4. Purchase and Payment

4.1. Pricing Model

"Background Changer" is available as a one-time purchase with no recurring subscription fees.

The purchase includes:

• Full access to all current widget features (20 themes and 104 SVG graphics)
• Future compatibility updates (bug fixes)
• Customer support for implementation issues

4.2. Additional Graphic Packs

Future graphic packs (e.g., 104 new SVG graphics planned for June 2026) will be available for 50% of the current widget price as a separate purchase. These packs are optional and do not affect the functionality of your existing widget.

4.3. Payment Processing

All payments for purchases made through our website are processed by Paddle, which acts as the Merchant of Record for all transactions. This means that Paddle:

• is the seller of record for all purchases and appears as the vendor on your payment statement;
• handles all payment processing, billing, and tax calculations (including VAT, sales tax, and other local taxes);
• issues all invoices, receipts, and transaction-related documentation;
• manages refunds, chargebacks, and payment disputes;
• processes payments securely in accordance with applicable security standards (e.g., PCI DSS).

By making a purchase through our website, you acknowledge and agree that:

• all payment data (such as credit card or other payment method information) is collected and processed directly by Paddle, and we do not store or have access to your full payment card or banking information;
• your billing relationship for the purchase is with Paddle and governed by Paddle’s Checkout Buyer Terms and Paddle’s Privacy Policy;
• Paddle may disclose applicable taxes and currency conversions based on your billing location.

For payment-related inquiries, refunds, or billing support, please refer to the links provided in your Paddle receipt email or contact Paddle support at: Paddle.

4.4. Refund Policy

All digital product purchases processed through Paddle are eligible for a full refund if requested within 14 days from the date of purchase, in accordance with Paddle’s Buyer Terms & Conditions. Requests made after 14 days will not be honored unless required by applicable law. To request a refund, please use the refund link in your Paddle receipt email or contact Paddle support at Paddle. Refunds will be issued to the original payment method within 14 days of approval.

5. Implementation Requirements

5.1. Technical Requirements

To use "Background Changer", your website must:

• Be built with standard web technologies (HTML, CSS, JavaScript)
• Have access to the website's root directory for file upload
• Not block or modify JavaScript execution
• Be compatible with modern browsers (Chrome, Firefox, Safari, Edge)

Please note that very old or marginal browsers that do not fully support modern HTML5, CSS, JavaScript features, or SVG files may have problems displaying or running the widget correctly.

5.2. Implementation Process

Implementation requires:

1. Choosing the button and widget style (from 22 available options)
2. Choosing the button position (from 10 available positions)
3. Copying one line of code into your HTML files (before the closing </body> tag)
4. Uploading 3 files (loader.js, widget.js, widget.css) and 1 folder ("background_changer") to your website's root directory

5.3. Graphic Updates

When purchasing additional graphic packs (e.g., the 104 new SVG graphics planned for April 2026), you can update your widget by:

• Method 1: Replace the existing "background_changer" folder with the new folder (keeping the same name)
• Method 2: Manually replace individual graphics within the existing folder

The folder name must always be "background_changer" for the widget to function properly.

6. Intellectual Property Rights

6.1. Ownership

All intellectual property rights in the "Background Changer" widget, including but not limited to:

• Source code (JavaScript, CSS)
• Graphic designs (SVG files)
• Documentation and implementation guides
• Branding and trademarks

are and shall remain the exclusive property of Krzysztof Jaroszuk. You are granted only the license rights specified in Section 3.

6.2. User-Generated Content

The widget does not collect, store, or transmit any user data or content. All background preferences are stored locally in the user's browser using localStorage.

6.3. Third-Party Components

The widget may include or use third-party components that are subject to their own licenses. We ensure all third-party components are properly licensed for our use and distribution.

7. Support and Updates

7.1. Support Scope

We provide support for:

• Implementation issues and troubleshooting
• Clarification of documentation
• Bug fixes

We do NOT provide:

• Custom development or modifications
• Support for custom-coded websites with non-standard implementations
• CSS or JavaScript customization beyond the provided 22 styles
• Website debugging unrelated to our widget

7.2. Update Policy

Your purchase includes:

• Bug Fix Updates: Corrections bugs and issues

Updates will be available until the "Background Changer" widget is available for purchase. The files originally purchased, as well as the files provided in updates, will remain the property of the buyer, while still being subject to use under the license and the rules set out in these Terms.

You will receive notifications about available updates to your email.

Updates do NOT include:

• New features or functionality (may be available as separate purchases)
• Additional graphic packs (available as separate purchases)
• Complete redesigns or rewrites of the widget

10. Indemnification

You agree to defend, indemnify, and hold harmless Krzysztof Jaroszuk from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the widget
• Your violation of any term of these Terms of Use
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the widget caused damage to a third party

11. Termination

These Terms are effective until terminated. Your license rights will terminate automatically without notice if you fail to comply with any provision of these Terms. Upon termination, you must:

• Cease all use of the widget
• Delete or destroy all copies of the widget files in your possession or control
• Remove the widget code from your website

Termination does not entitle you to a refund of any purchase price paid.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the widget after any such changes constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the widget shall be resolved through good faith negotiations. If such negotiations fail, the dispute shall be submitted to the competent courts of Poland.

14. General Provisions

14.1. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the "Background Changer" widget and supersede all prior agreements and understandings.

14.2. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4. Assignment

You may not assign or transfer these Terms or your license rights without our prior written consent. We may assign or transfer these Terms without restriction.
